Thank you for choosing BackupKit ("Service"), a cloud-based database backup solution operated by Cloudstack FZE ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our Service. Please read these Terms carefully before you start to use the Service.

By using BackupKit, registering an account, or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Service.

1. Access and Use of the Service

• Service Description: BackupKit is a Service for creating database backups on the cloud.
• Account Registration: You may be required to register for an account to access the Service. You agree to keep your password confidential and will be responsible for all use of your account and password.
• Acceptable Use: You agree not to use the Service in any way that is unlawful, illegal, or harmful to others.

2. Payment

• Fees: You agree to pay all applicable fees for the Service as set forth on our pricing page and as otherwise specified in these Terms.
• Subscriptions: Service may be provided on a subscription basis. You will be billed in advance on a recurring, periodic basis unless and until you cancel your subscription or the Service is terminated by us.

3. Intellectual Property Rights

• Ownership: All intellectual property rights in the Service and its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) belong to the Company or its licensors.

4. Termination

• By You: You may stop using the Service at any time. If you wish to terminate your account, you may simply discontinue using the Service or, where applicable, use the account termination functionality within the Service.
• By Us: We may suspend or terminate your access to the Service at our discretion without notice if we believe that you have breached these Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law provisions.
